Sunshine Law & Public Records Policy

Effective Date: October 21, 2026

Redings Mill Fire Protection District (“RMFPD,” “the District,” “we,” “our,” or “us”) is committed to transparency, accountability, and providing the public with access to government information in accordance with Missouri law.

As a public fire protection district in Missouri, RMFPD is subject to the Missouri Sunshine Law, Chapter 610 of the Revised Statutes of Missouri (RSMo), and applicable provisions of Chapter 321 governing fire protection districts.

This Sunshine Law & Public Records Policy explains the public’s right to access District records, request information, attend public meetings, and understand the procedures used to respond to records requests.

Commitment to Government Transparency

RMFPD recognizes that open government promotes public trust, accountability, and informed community participation.

In accordance with Missouri’s Sunshine Law, meetings, records, votes, actions, and deliberations of public governmental bodies are generally open to the public unless otherwise provided by law.

The District supports public access to information regarding its administration, operations, finances, governance, and services, consistent with applicable legal requirements.

Missouri Sunshine Law

The Missouri Sunshine Law, primarily established under Chapter 610, RSMo, governs public access to meetings, records, and votes of public governmental bodies.

Under this law, members of the public generally have the right to:

  • Request access to public government records
  • Inspect and obtain copies of available public records
  • Attend meetings required by law to be open to the public
  • Access meeting notices and agendas
  • Review public meeting minutes and voting records
  • Request information about governmental operations and expenditures

Certain records, meetings, or portions of records may be closed when specifically authorized or required by applicable law.

For additional information, visit the Missouri Attorney General’s Sunshine Law resource page.

Public Records Available for Inspection

RMFPD maintains records related to the administration and operation of the District. Public records may include, but are not limited to:

  • Board meeting agendas and approved minutes
  • Public meeting notices and voting records
  • District budgets and financial statements
  • Public expenditure and purchasing records
  • Contracts and agreements
  • District policies, resolutions, and administrative documents
  • Public reports and operational information
  • Fire prevention and community education materials
  • Other records maintained by the District that are open under applicable law

Public records may exist in paper, electronic, or other formats.

The availability of a record depends on whether the District maintains the requested information and whether disclosure is required or permitted by applicable law.

Some records may contain confidential or legally protected information that must be withheld or redacted before release.

How to Request Public Records

Individuals seeking access to District public records may submit a request through the contact information provided below.

Requests may be made by email, telephone, mail, or other methods permitted by law. Written requests are encouraged to help document the information requested and facilitate an accurate response, but no particular form is generally required under Missouri’s Sunshine Law.

To help the District identify responsive records, requests should include, when available:

  • The requester’s name
  • Contact information for receiving a response
  • A clear description of the records requested
  • Relevant dates or time periods
  • Preferred record format, if applicable
  • Whether inspection or copies are requested
  • A request for an estimated cost, if desired

Requests should be sufficiently descriptive to allow the District to identify and locate the records.

The District will direct requests received through its general contact information to the appropriate records custodian or authorized personnel.

Custodian of Records

Under Section 610.023, RSMo, each public governmental body must appoint a custodian responsible for maintaining its records.

RMFPD’s officially designated Custodian of Records is responsible for coordinating access to public records and responding to requests in accordance with applicable law.

The identity and location of the District’s designated Custodian of Records are available upon request.

Individuals may contact the District using the information at the end of this policy to obtain the custodian’s contact information or assistance directing a records request.

Response Times

Under Section 610.023, RSMo, requests for access to public records must be acted upon as soon as possible, but no later than the end of the third business day following receipt by the designated Custodian of Records.

This requirement does not necessarily mean that all requested records must be produced within three business days.

If immediate access cannot be provided, the custodian must explain the reason for the delay and identify the place and earliest time and date when the records will be available for inspection.

The time required to produce records may exceed three business days when reasonable cause exists, consistent with applicable law.

Factors affecting production may include:

  • The number and volume of records requested
  • The time required to locate or retrieve records
  • The format in which records are maintained
  • The need to review records for legally protected information
  • Other circumstances constituting reasonable cause under applicable law

RMFPD will address records requests in accordance with statutory requirements and provide additional information when further processing time is necessary.

Public Records Inspection

Public records available for disclosure may be inspected through arrangements coordinated with the District’s authorized personnel.

Under Section 321.200, RSMo, applicable fire protection district records, including board meeting minutes, are available for inspection at the District’s main firehouse by appointment with the Secretary of the Board, within the statutory timeframe following a written request.

Arrangements for inspection will be made in accordance with applicable law and District procedures.

Original public records generally may not be removed from the custody of the District without written permission from the designated custodian.

Individuals wishing to inspect records in person should contact the District to coordinate access.

Public Records Fees

Fees for accessing or obtaining copies of public records are governed by Section 610.026, RSMo, and other applicable laws.

For standard paper records not larger than 9 by 14 inches, copying fees generally may not exceed:

  • Ten cents ($0.10) per page
  • An hourly duplication charge not exceeding the average hourly rate of pay for District clerical staff
  • Permissible research costs calculated as provided by law

Different statutory fee calculations may apply to electronic records, recordings, maps, larger documents, specialized materials, or records requiring additional technical processing.

Where fees apply, they will be calculated in accordance with applicable law and the District’s adopted fee schedule.

Requesters may ask for an estimated cost before copies are produced.

As permitted by Missouri law, the District may require payment of applicable fees before fulfilling a request.

Under Section 610.026, RSMo, a request may be considered withdrawn if a requester does not pay properly requested fees or respond to a request for clarification within the applicable statutory period after receiving the required notice.

The applicable period is generally 90 days, or 150 days when requested fees exceed $1,000, subject to the provisions and exceptions established by law.

Fee Waivers and Reductions

Missouri law permits public governmental bodies to provide records without charge or at a reduced cost when the governmental body determines that doing so is in the public interest.

Such determinations may consider whether disclosure is likely to contribute significantly to public understanding of government operations or activities and is not primarily in the requester’s commercial interest.

Requests for fee waivers or reductions may be submitted for District consideration in accordance with applicable law.

Electronic Records

RMFPD may maintain public records electronically, including documents, correspondence, reports, and other information related to District operations.

Public records are not excluded from disclosure solely because they are maintained electronically.

When records are requested in a particular format, the District will provide them in that format if it is available, as required by Section 610.023, RSMo.

Electronic records requests are subject to the same applicable disclosure requirements, exemptions, and lawful fees as other public records.

Confidential and Closed Records

While Missouri law generally favors open access to public records, certain records or portions of records may be closed or protected from disclosure under Section 610.021, RSMo, or other applicable laws.

Depending on the circumstances and applicable legal provisions, protected information may include:

  • Confidential or privileged legal communications
  • Certain personnel and employment applicant records
  • Information protected by federal or state confidentiality laws
  • Eligible emergency response or public safety security information
  • Specific security plans, procedures, and access credentials
  • Information concerning protected medical or personal matters
  • Other information specifically authorized or required to be withheld by law

Any decision to withhold a record or portion of a record will be based on an applicable legal provision.

Records are not considered confidential merely because they are sensitive, inconvenient, or associated with District personnel.

Redaction and Partial Disclosure

Under Section 610.024, RSMo, when a public record contains both information that is open to disclosure and information that is legally exempt, the District must separate the exempt material and make the nonexempt information available.

Redactions or withheld portions will be handled in accordance with applicable law.

When legally required or appropriate, the District will identify the grounds for withholding information without disclosing the protected material itself.

Denial of Records Requests

If access to a requested public record is denied, the requester may ask the Custodian of Records for a written explanation of the denial.

Under Section 610.023, RSMo, the custodian must provide a written statement identifying the specific legal grounds for denial no later than the end of the third business day following receipt of the request for that statement.

The District will review requests and determine whether disclosure is required or restricted under applicable law.

Individuals who believe a public records request has not been handled in accordance with Missouri’s Sunshine Law may consult the Missouri Attorney General’s Office for information about applicable remedies and complaint procedures.

Board Meetings and Public Access

Redings Mill Fire Protection District is governed by a Board of Directors responsible for the District’s administration and oversight.

Board meetings are conducted in accordance with applicable provisions of Missouri law, including Chapter 610 and Section 321.200, RSMo.

Public meetings are generally open to the public unless a lawful exception authorizes a closed meeting or portion of a meeting.

Meeting notices will be provided in accordance with applicable statutory requirements.

Under Section 610.020, RSMo, public meeting notices generally identify:

  • The date and time of the meeting
  • The meeting location
  • A tentative agenda
  • Information regarding electronic participation or access when applicable

Unless a lawful exception applies, notice is generally required at least 24 hours before a public meeting, excluding weekends and holidays when the facility is closed.

Applicable posting requirements, including those specific to fire protection districts, will be followed.

RMFPD maintains meeting minutes and voting records as required by law.

Members of the public may request access to available meeting records through the District’s public records request procedures.

Closed Meetings and Executive Sessions

Certain meetings or portions of meetings may be closed to the public when specifically authorized by Missouri law.

Closed meetings and records are governed by applicable provisions of Chapter 610, including Sections 610.021 and 610.022, RSMo.

Closed sessions may be used only for legally authorized purposes and must follow applicable procedural requirements.

RMFPD will not treat an entire meeting or record as confidential merely because a portion qualifies for lawful closure.

Meeting notices, minutes, and voting information will be maintained or released as required by applicable law.

Records Retention

RMFPD maintains public records in accordance with applicable Missouri records retention requirements, District policies, and other legal obligations.

Retention periods may vary depending on the nature, classification, and purpose of the records.

Records will not be intentionally destroyed or altered to avoid lawful public disclosure or applicable retention obligations.

The District will preserve records as required by applicable law, including records subject to legally required retention or preservation.

Website Publications and Public Information

The RMFPD website may provide public access to selected records, including board meeting materials, reports, administrative information, and District announcements.

Not all records maintained by the District are necessarily published online.

The absence of a document from the website does not necessarily mean the document is unavailable as a public record.

Individuals may request records that are not available online by contacting the District.

Website publications may be corrected or updated when appropriate, subject to applicable records management requirements.

Accessibility of Public Records

RMFPD is committed to improving accessibility and providing individuals with disabilities meaningful access to public information.

Individuals who encounter difficulty accessing electronic documents or public records may contact the District to request assistance or an alternative accessible format.

Requests for accessible records will be reviewed in accordance with applicable requirements of the Americans with Disabilities Act (ADA) and other relevant laws.
